Terms of Service, Acceptable Usage Policy
The use of services from WebTHosting.com (WebT Hosting) constitutes agreement to these terms. You may also want to view our Privacy Policy.
1.) Account Setup / e-mail on file
We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an e-mail address which is not @ the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you, the primary e-mail address on file will be used for this purpose. It is your responsibility to ensure the e-mail address on file is current or up to date at all times. Providing false contact information of any kind may result in the termination of your account without any refund.
You must change the password of your hosting account immediately after you receive the activation e-mail. Never provide your password in any way to us other than in a support ticket.
1a.) Account Transfers
Our transfers team will make every effort to you move your site to us. However, transfers are provided as a courtesy service, and we can not make guarantees regarding the availability, possibility, or time required to complete an account transfer. Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format, which may make it extremely difficult if not impossible to migrate some or all account data. We will try our best, but in some cases we may be unable to assist you in a transfer of data from an old host.
The free transfer services are available for 30 days from your sign up date. Transfers outside of the 30 day free period will incur a charge; please contact us with specific details to receive a price quote.
2.) Content
The customer agrees to indemnify and hold harmless WebT Hosting from any claims resulting from the use of our services. You are responsible for any data stored on our server.
We strictly do not allow spamming, phishing sites, hosting or linking to child pornography, IP spoofing, (D)Dos attacks, hacking, or virus/malware/trojan, Rapidleech or similar for public usage, torrent trackers, Torrentflux or similar on any service on our network. Violating the terms will get your hosting account terminated without any warning, without any refund.
Failure to respond to email from our abuse department within 24 hours may result in the suspension or termination of your services.
Examples of unacceptable material on all hosting accounts include but are not limited to:
- Mail Bombers/Spam Scripts
- Escrow/Bank Debentures/Bank Debenture Trading Programs/Phishing Sites
- Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)
- Child Porn
- IP Spoofing, Making (D)Dos attacks, Hacking, Virus/Malware/Trojan
IF ANY PHISHING SITE (EXAMPLE: PAYPAL, EBAY OR BANK DUPLICATE SITES, ETC) IS FOUND YOUR ACCOUNT WILL IMMEDIATELY BE TERMINATED WITHOUT A REFUND AND YOUR ACCESS LOGS INCLUDING YOUR IP WILL BE SENT TO THE APPROPRIATE LAW ENFORCEMENT AGENCIES.
Running shell scripts or malicious scripts on a shared web hosting account or a reseller web hosting account is not allowed and will not be tolerated.
WebT Hosting services, including all related equipment, networks and network devices are provided only for legal and authorized customer use. WebT Hosting systems may be monitored for all lawful purposes, to ensure that use is authorized, for management of the system, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. During monitoring, information may be examined, recorded, copied and used for authorized purposes. Use of WebT Hosting system(s) constitutes consent to monitoring for these purposes.
We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice.
Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography (Lolita):
Any site found to host child pornography or linking to child pornography will be suspended/terminated immediately without notice, without any refund.
Resellers: We will suspend the site in question and will notify you so you may terminate the account. We will further monitor your activity; if it repeats continuously we reserve the right to suspend your account.
Direct customers: Your services will be suspended/terminated with/without notice.
It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as user name and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password.
3.) Zero Tolerance Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, bulk e-mailing, and spam. "Safe lists" and purchased lists will be treated as spam. Any user who sends out spam will have their account terminated with/without notice, without any refund. If your actions have caused any IP addresses of any of our servers to be placed on any blacklists or any other email filtering software systems, a $75 charge will be added to your account in addition to $75 per hour beyond the first hour for administrative charges incurred to remove and protect our servers and IP addresses from any blacklists or other email filtering software systems.
Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, e-mail, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
WebT Hosting reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.
WebT Hosting reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee or any charges incurred for blacklist removal. This cost of the clean up fee is entirely at the discretion of WebT Hosting.
4.) Payment Information & Account Cancellation
You agree to supply appropriate payment for the services received from WebT Hosting, in advance of the time period during which such services are provided. You may cancel the service at any time you feel just by opening a support ticket and you will not be billed after that. You agree that until and unless you notify WebT Hosting of your desire to cancel any or all services received, those services will be billed on a recurring basis.
Canceling your account will remove all files/e-mails/databases stored under your account.
As a client of WebT Hosting, it is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. Any invoice that is outstanding after the overdue date and not paid will result in a $10 late fee and/or an account suspension/termination with/without any notice until account balance has been paid in full. Once the account has been terminated due to non-payment, the data can not be recovered.
Invoices that have been paid more than once with multiple Paypal Subscriptions can only be added as credit towards the account and cannot be refunded via Paypal.
WebT Hosting reserves the right to change the monthly payment amount and any other charges at anytime.
5.) Backups and Data Loss
Your use of this service is at your sole risk. Our backup service is provided as a courtesy. In case of a hard drive failure your data may be lost, the user has to take regular off-site backups himself. WebT Hosting is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on WebT Hosting servers. You are advised to keep off-site backup of your data to protect it from being lost should there ever be any hard disk failure though we do not expect a hard drive failure. We will backup your data regularly on several plans but in some situations they may not be restored. We can not be held responsible if any data is lost during situations including but not limited to hard drive failure. WebT Hosting can not be held responsible for any loss in data.
6.) Cancellations and Refunds
WebT Hosting reserves the right to cancel your account at any time with/without notice.
We believe in professional communication, no matter what the issue is. We will not tolerate any abusive behavior, abusive language or threats against us. Any abuse or threaten in any medium or format will result in the immediate suspension/termination of your services without a refund.
Customers may cancel at any time from the client area. WebT Hosting gives you a 30 day money back guarantee on shared hosting, reseller hosting and VPS for any customer who paid with a credit card or 2CheckOut or with Paypal. Requests after the first 30 days will not be honored. Other methods of payments are non-refundable, and the balance will be posted as credit to your account which you can use later.
We do not accept cash payments.
There are no refunds on dedicated servers, setup fees, transaction fees, administrative fees, installation fees for custom software, or domain name purchases.
Only first-time accounts are eligible for a refund. For example, if you've had a hosting service with us before, canceled and signed up again, or if you have opened a second account with us, you will not be eligible for a refund.
We may require you to provide a screenshot of your credentials used during the transaction for verification if we feel it is needed and to fight against the increasing internet frauds. We may even call/contact the credit card company to verify your order/identity at our sole decision.
Violations of the Terms of Service will waive any refund.
7a.) Resource Usage
Fair usage policy is applicable on shared web hosting and reseller web hosting as a number of users will be sharing the same server. We reserve the right to impose limits if you abuse the server resources.
User may not abuse the system or network resources; doing so may lead to suspension/termination of your account with/without notice.
If our system administrators determine that a customer's account is utilizing an unacceptable amount of system or network resources that will affect other users, we may temporarily deactivate the account in question and request the client to upgrade his/her service. We may contact the client to offer alternative solutions for their accounts and make our best attempt to keep their account active without degredation to other clients' services. WebT Hosting will be the sole arbiter as to what constitutes a violation of this provision.
Using a shared/reseller web hosting account mainly for hosting/storing/dumping large files or similar is not allowed.
User may not, on shared web hosting and reseller web hosting,:
a) use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
b) run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
c) run any software that interfaces with an IRC (Internet Relay Chat) network.
d) run/use/store any type of shell script or any malicious script, run bots.
e) participate in any file-sharing/peer-to-peer activities.
f)
run any gaming servers such as counter-strike, half-life, battlefield1942, etc.
g)
run cron entries with intervals of less than 15 minutes.
h) use I/O intensive applications which adversely affect normal server operations.
User may not, on VPS hosting,:
a) exceed a 15 minute load average of greater than 8.
b) run malicious bots.
c) use I/O intensive applications which adversely affect normal server operations.
7b.) Backup Limit
Any shared/reseller account using more than 20 GB of disk space will be removed from our backup system. All data will continue to be mirrored to a secondary drive which helps protect against data loss in the event of a drive failure. You are requested to have your own off-site backups. We can not be held responsible for any data loss should there be any failure.
7c.) Attacks and Exploits
Any activity which affects the ability of other people or systems to use any services or other internet services. This includes "denial of service" (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the client's responsibility to ensure that their server is configured in a secure manner. A client may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. Unauthorized entry and/or use of another company and/or individual's computer system will result in immediate account termination. We will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems.
8.) Bandwidth Usage
You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.
9.) Money back Guarantee
On dedicated servers no full refund will be honored -- the 30 day money back guarantee does not apply. We reserve the right to refund a prorated amount or no refund at all.
Each of WebT Hosting's shared, reseller and VPS plans listed on our site carries a 30 day money back guarantee except any custom-made plan. Any custom-made plan is not eligible for a refund. If you are not completely satisfied with our services within the first 30 days of your signup, you will be given a refund excluding domain registration charges (and/or any transaction and/or setup charges if applicable). The refund policy only applies to your first invoice paid to us, and not on any subsequent invoice. No refund is available on upgrades. Remember, this is only for shared or reseller or VPS packages and does not apply to dedicated servers, administrative fees, installation fees for custom software, or domain name purchases.
10.) Uptime Guarantee
WebT Hosting will maintain an average network uptime of 99.9% or more per year. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor's network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system which may differ from the uptime reported by other individual services. Uptime guarantees only apply to shared/reseller solutions. Dedicated servers and virtual private servers are covered by a network uptime guarantee. The uptime does not include hardware failures or natural disasters or circumstances which are not in our control.
11.) Reseller: Client Responsibility
Resellers are responsible for supporting their clients. WebT Hosting does not provide support to our Reseller's Clients. All support requests must be made by the reseller on their clients' behalf for security purposes. Resellers are also responsible for all content stored or transmitted under their reseller account and the actions of their clients'. WebT Hosting will hold any reseller responsible for any of their clients actions that violate the law or the terms of service.
12.) Shared (non-reseller accounts) / Semidedicated Servers
Shared accounts may not resell web hosting to other people, if you wish to resell hosting you must use a reseller account. Semi-dedicated servers are not backed up. You must maintain your own backups. However you may transfer your entire hosting account to someone else after notifying us by opening a support ticket.
13.) Price Change
We reserve the right to change prices listed on WebTHosting.com, and the right to change the amount of resources given to plans at any time.
14.) Coupons
Discounts and coupon codes are reserved for first-time accounts or first-time customers only and may not be used towards the purchase of a domain registration unless otherwise specified. If you have signed up using a particular domain, you may not resign up for that domain using another coupon at a later date. Any account found in violation of these policies will be reviewed by our sales department and the appropriate invoices will be added to the account. A coupon code can not be applied to an order after it is placed. Coupon abuse will not be tolerated and may result in the suspension or termination of the account.
15.) Rebate/Credit
In order to qualify for a credit from WebT Hosting, you must provide the following information via our ticket system.
- Your original welcome and cancellation documents from your previous host
- We need to see clearly the domain and services you applied for and the pricing agreement
- We need exact copies of the original e-mails from your previous host in digital or physical format
- The name of the domain to be transferred
- The contract terms and conditions of the previous host
- If you received a refund from your former host as per their terms of service, no credit can be provided by us.
- The credit will be issued as validity to your hosting account with us, to be applied to your next invoice. The amount of the credit will be the pro-rated balance for services left on your account with your former host, not to exceed $50. For more details please visit here.
The information must be provided to us in the format set out in the website. If the information provided satisfies our requirements, you will receive your rebate as an account credit that will apply to your next invoice. Credit will be granted only to the registered account holder. The rebate will be given once your account has remained open for more than 30 days. We reserve the right to refuse a rebate if you provide insufficient documentation. Submission of a rebate request indicates your acceptance of these terms. One rebate will be given per Client ID. Our determination regarding whether or not you qualify for a rebate will be final.
16.) For VPS
a) Please note that cPanel license or any other control panel which requires a paid license is not free. You will have to get your own license.
b) Free management includes troubleshooting a VPS-issue for free. If you decide to use cPanel on your VPS we offer fully managed support. Fully managed support means that we will handle just about any issue or configuration request you may have with your server outside of custom software/script installations. Where free management is not available (example: custom PHP scripts, if you are not using cPanel, etc) we offer help at only $10 per hour.
17.) Indemnification
Customer agrees that he/she shall defend, indemnify, save and hold WebT Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against WebT Hosting, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless WebT Hosting against liabilities arising out of your use of WebT Hosting's server.
18.) Disclaimer
WebT Hosting shall not be responsible for any damage your business may suffer. WebT Hosting makes no warranty of any kind, expressed or implied for services we provide. WebT Hosting disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by WebT Hosting and its employees.
19.) Changes to the Terms
WebT Hosting reserves the right to revise its policies at any time without notice.
Signing up for an account at WebT Hosting signifies that you have completely read the terms and conditions stated above, fully understand and agree to them.
